This is the first decision, dismissing the first application to quash the extra-judicial subpoenas of the NYS Attorney General against state-licensed dealers in firearms Blue Line Sports and Woods and Waters. It is one of two decisions. The NEW Decision and Order is found HERE.
Academically, these two decisions are an excellent discussion of the rarely used CPLR Rule 2304 motion to quash extra-judicial subpoenas issued by the NYS Attorney General. These clear up both the better form of filing and the timing of the filing. The second decision also provides some discussion of the particular facts of the Blue Line Sports cases to define the “context” of our challenge.
